The highest court in the European Union has ruled in favor of copyright holders in their never ending fight against The Pirate Bay and others. In a ruling from the European Court of Justice (CJEU), it was decided Dutch internet service providers (ISPs) must block access to the site.
ISPs are mandated to block access to The Pirate Bay because it facilitates illegal activity.
Making available and managing an online platform for sharing copyright-protected works, such as 'The Pirate Bay,' may constitute an infringement of copyright,- CJEU
This particular case stems from BREIN, a Dutch anti-piracy group, going after local ISPs Ziggo and XS4All. BREIN won in 2012, but the ISPs overturned that ruling a couple years later. It was then referred to the Supreme Court before making its way to the European Court of Justice.
With this ruling at the EU level, anti-piracy actions could spread to other countries. Copyright holders could utilize this ruling to target other ISPs.
